Terms of Use

1. Acceptance of these terms

These Terms of Use ("Terms") govern participation in the Sprout Speakers Championship and use of the wider Sprout Life Skills platform (the "Platform"), operated by Sprout Life Skills, a partnership with its registered address at TRC, Tigoni Road, Nairobi, Kenya ("Sprout," "we," "us," or "our"). By registering a child for the Sprout Speakers Championship, or otherwise using the Platform, a parent or guardian agrees to be bound by these Terms on behalf of themselves and the child they are registering.

2. Who may participate

The Sprout Speakers Championship is open to children aged 6 to 17, organised into three age bands: Sprout Spark (6 to 9), Teen Titans (10 to 13), and Sprout Stars (14 to 17). A child may only be registered by their parent or legal guardian. Entry into the Sprout Speakers Championship is free of charge.

3. The parent or guardian is the responsible party

Regardless of a child's age or program, the parent or guardian who registers a child is the accountable party under these Terms. All consents, agreements, and decisions relating to a child's participation, including consent to recording, publication, and use of their personal data, rest solely with the parent or guardian, and are governed by our Privacy Policy.

4. Registration and entry

To enter the Sprout Speakers Championship, a parent or guardian must submit a video recording of their child's speech through the process specified by Sprout at the time of entry, along with any information Sprout reasonably requires to process that entry. A parent or guardian is responsible for the accuracy of any information submitted.

5. Content guidelines

Every speech submitted must comply with the following rules:

  • A speech may not attack, name, or identify any individual, politician, political party, school, or community, even where the speech addresses a difficult or sensitive topic.
  • A speech must be the child's own words and thinking. It should not be written in substantial part by an adult.
  • A speech must stay within the topic and time limits set for the relevant age band and season.

Sprout reserves the right to reject, withhold from publication, or remove any entry that does not comply with these guidelines, at its sole discretion.

6. Judging

Judging is blind. Judges score each speech without being shown the child's surname, school, or town. Sprout's decisions regarding scoring, advancement, and placement in the competition are final.

7. License to use submitted content

By submitting a speech, the parent or guardian grants Sprout a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and share that speech, including on the Sprout Speakers Championship website and Sprout's official social media channels, for purposes connected to the competition and Sprout's wider mission. This license is open-ended and is not limited to a single competition season.

This license does not transfer ownership of the speech or recording away from the family. A parent or guardian remains free to post, share, or otherwise use the same content elsewhere, without restriction from Sprout.

8. What we publish, and what we don't

Where a speech is published, we display the child's first name, age, speech topic, and county or town. We do not publish a child's surname, school name, or exact home address. There is no public comments section on any published speech.

9. Requesting removal

A parent or guardian may request that their child's speech be removed from the Platform and any Sprout-controlled social media channel at any time, by contacting support@sprouts.co.ke, as set out in our Privacy Policy.

10. Prohibited conduct

In using the Platform, you agree not to:

  • Submit content on behalf of a child that is not that child's own genuine work.
  • Impersonate another person or misrepresent your relationship to a child you are registering.
  • Attempt to interfere with the fair and blind operation of the judging process.
  • Use the Platform for any unlawful purpose.

11. Disclaimers

The Platform, and participation in the Sprout Speakers Championship, are provided on an "as is" and "as available" basis. Sprout does not guarantee that the Platform will be uninterrupted or error-free, and does not guarantee any particular outcome, placement, or level of public exposure for any entry.

12. Limitation of liability

To the maximum extent permitted by the laws of Kenya, Sprout shall not be liable for any indirect, incidental, or consequential loss arising from participation in the Sprout Speakers Championship or use of the Platform. Nothing in these Terms limits any liability that cannot be excluded under Kenyan law.

13. Suspension and termination

Sprout may suspend or terminate an entry, or a family's participation in the Platform, at its discretion, where these Terms or our content guidelines have been breached.

14. Changes to these terms

We may update these Terms from time to time. Where a change is material, we will take reasonable steps to notify parents and guardians, including by email or WhatsApp, before the change takes effect. Continued participation in the Platform after a change takes effect constitutes acceptance of the updated Terms.

15. Governing law and dispute resolution

These Terms are governed by the laws of the Republic of Kenya, including the Constitution of Kenya. In the event of a dispute arising out of or relating to these Terms or participation in the Platform, the parties agree to first attempt to resolve the dispute amicably, and, failing that, through mediation. If a dispute cannot be resolved through mediation, it shall be referred to and finally resolved by arbitration in Nairobi, Kenya, in accordance with the Arbitration Act (Kenya), conducted in English. The seat of arbitration shall be Nairobi.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between a parent or guardian and Sprout regarding participation in the Sprout Speakers Championship and use of the Platform.
